Cijelo Izvje\u0161\u0107e mo\u017eete otvoriti u <a href=\"https:\/\/www.ombudsman.hr\/hr\/download\/izvje-e-pu-ke-pravobraniteljice-za-2024-godinu\/?wpdmdl=20339&#038;refresh=6810acc1b4c8b1745923265\">PDF formatu<\/a> ili u <a href=\"https:\/\/www.ombudsman.hr\/hr\/interaktivno-izvjesce-za-2024\/\">interaktivnoj verziji<\/a>.<\/em><\/h4>\n<hr \/>\n<p>U 2024. godini postupali smo u ukupno 6.404 predmeta, od kojih je 4.921 predmet otvoren po pritu\u017ebi gra\u0111ana ili na vlastitu inicijativu (77%), dok se 1.268 predmeta odnosilo na op\u0107e inicijative, \u0161to primjerice uklju\u010duje mi\u0161ljenja na prijedloge zakona ili obilaske (20%) te 215 na uredsko poslovanje (3%).<\/p>\n<p>Od ukupnog broja predmeta po kojima smo postupali, u 2024. godini otvorena su 4.942 nova predmeta, \u0161to je 2,81% vi\u0161e u odnosu na godinu ranije, dok su 1.462 predmeta prenesena iz prethodnih godina.<\/p>\n<p>Od ukupnog broja predmeta otvorenih u 2024. godini, po pritu\u017ebama gra\u0111ana ili na vlastitu inicijativu otvoreno je 3.716 novih predmeta, op\u0107ih inicijativa bilo je 1.011, a 215 predmeta je otvoreno za uredsko poslovanje.<\/p>\n<p>U nastavku su prikazani novi predmeti otvoreni u 2024. po pritu\u017ebi gra\u0111ana ili na vlastitu inicijativu (3.716).<\/p>\n<p><img fetchpriority=\"high\" decoding=\"async\" class=\"alignnone wp-image-20617\" src=\"https:\/\/www.ombudsman.hr\/wp-content\/uploads\/2025\/04\/1-3-300x259.png\" alt=\"\" width=\"771\" height=\"666\" \/><\/p>\n<p>Za razliku od posljednjih godina, kada je najvi\u0161e predmeta po pritu\u017ebi gra\u0111ana ili na vlastitu inicijativu otvoreno u podru\u010dju zdravstva, u 2024. najvi\u0161e je predmeta, njih 420, otvoreno u podru\u010dju diskriminacije, u razli\u010ditim podru\u010djima \u017eivota. Potom su najzastupljenije pritu\u017ebe na zdravstvo (394), podru\u010dje radnih i slu\u017ebeni\u010dkih odnosa (327), gospodarstva i obrta (258), komunalnih djelatnosti (219), imovinsko-pravnih odnosa (214), socijalne skrbi (204), graditeljstva i prostornog ure\u0111enja (189) te pravosu\u0111a (178). Usporedba novootvorenih predmeta s 2023. godinom pokazuje kako je do najve\u0107eg pove\u0107anja (81%) do\u0161lo glede tra\u017eitelja me\u0111unarodne za\u0161tite, potom komunalnih djelatnosti (66%) te u podru\u010dju graditeljstva i prostornog ure\u0111enja (36%).<\/p>\n<p><img decoding=\"async\" class=\"alignnone wp-image-20618\" src=\"https:\/\/www.ombudsman.hr\/wp-content\/uploads\/2025\/04\/2-3-272x300.png\" alt=\"\" width=\"781\" height=\"861\" \/><\/p>\n<p>Od 4.921 predmeta u kojima smo tijekom godine postupali po pritu\u017ebama gra\u0111ana ili na vlastitu inicijativu, rad je okon\u010dan u 2.756. Preostalih 2.165 predmeta preba\u010deno je u narednu godinupritu\u017ebe koje su pristigle krajem godine te je postupak jo\u0161 u tijeku, kao i slo\u017eenije pritu\u017ebe u kojima je postupak dugotrajniji\u00a0 ili u kojima ne zaprimamo na vrijeme odgovore javnopravnih tijela na \u010dije se postupanje gra\u0111ani \u017eale ili koje tra\u017eimo mi\u0161ljenje iz njihove nadle\u017enosti).<\/p>\n<p>Prema metodologiji koju smo po\u010deli primjenjivati 2023. godine, od 2.756 predmeta u kojima je rad zavr\u0161en u 2024. godini, u 35% smo provodili ispitni postupak, a u 65% predmeta nije bilo mogu\u0107nosti provesti ga. Me\u0111u navedenih 65% (1.788) pritu\u017ebi zna\u010dajan broj ih je bio podnesen pu\u010dkoj pravobraniteljici nakon \u0161to je o istoj stvari ve\u0107 odlu\u010dilo nadle\u017eno javnopravno tijelo ili sud ili je postupak jo\u0161 bio u tijeku, a dio pritu\u017eitelja nam se nije povratno javio nakon \u0161to smo zatra\u017eili vi\u0161e informacija o predmetu pritu\u017ebe. Me\u0111utim, najve\u0107i dio ovakvih pritu\u017ebi \u010dine one za \u010dije rje\u0161avanje je bilo nadle\u017eno drugo javnopravno tijelo.<\/p>\n<p>Kada nismo mogli provoditi ispitni postupak, pritu\u017ebe smo proslje\u0111ivali tijelima nadle\u017enima za njihovo rje\u0161avanje, uklju\u010duju\u0107i posebnom pravobranitelju\/icama te smo gra\u0111anima odgovarali daju\u0107i im op\u0107e informacije. Pri tome procesna nemogu\u0107nost vo\u0111enja ispitnog postupka i dalje omogu\u0107ava uvid u problem za koji smo saznali iz pritu\u017ebe gra\u0111ana. Ujedno, iako u odnosu na neke pritu\u017ebe pu\u010dka pravobraniteljica ne mo\u017ee postupati po ZoPP-u na na\u010din da vodi ispitni postupak, pru\u017eaju nam uvid za potrebe izvje\u0161tavanja o stanju ljudskih prava, koje je obveza institucije i u pogledu podru\u010dja u kojima nije ovla\u0161tena voditi ispitne postupke.<\/p>\n<p>Od 35% ili 968 pritu\u017ebi u kojima smo vodili ispitni postupak, 37% (358) je bilo osnovano, neosnovanih je bilo 33% (320), a u 30% (290) predmeta je ispitni postupak bio pokrenut, no obustavljen je zbog odustanka pritu\u017eitelja ili druge objektivne okolnosti.<\/p>\n<p><img decoding=\"async\" class=\"alignnone wp-image-20620\" src=\"https:\/\/www.ombudsman.hr\/wp-content\/uploads\/2025\/04\/3-1-300x250.png\" alt=\"\" width=\"750\" height=\"625\" \/><\/p>\n<p>U 358 osnovanih pritu\u017ebi postupali smo na razli\u010dite na\u010dine pri \u010demu je u pogledu 48 podnesen zahtjev za pokretanje postupka za ocjenu ustavnosti pojedinih odredbi Zakona o izmjenama i dopunama ZOZO-a, u 99 predmeta je dana preporuka, u 14 prijedlog, u 13 mi\u0161ljenje, u 24 upozorenje, a u 23 predmeta vi\u0161e mjera istovremeno. U preostalim osnovanim predmetima smo postupali na drugi na\u010din, a naj\u010de\u0161\u0107e je tijekom na\u0161eg postupanja, odnosno prije izdavanja mjere, javnopravno tijelo (odnosno pritu\u017eeni) samo ispravilo vlastito postupanje.<\/p>\n<p>Uz sve pritu\u017ebe koje su evidentirane u ovdje iznesenim statisti\u010dkim podacima, gra\u0111anima smo pomagali i odgovaranjem na upite koje su nam postavili telefonskim pozivima ili osobnim dolascima, pri \u010demu su im pru\u017eene potrebne informacije i upiti, a kojih je tijekom pro\u0161le godine bilo 1.246.<\/p>\n<p>&nbsp;<\/p>\n<h3><span style=\"font-size: 18px; color: #993300;\">Statisti\u010dki podaci o postupanju povodom diskriminacije<\/span><\/h3>\n<p>Tijekom 2024. godine postupali smo u 751 predmetu povodom diskriminacije, od \u010dega je 613 predmeta otvoreno temeljem pritu\u017ebi gra\u0111ana ili na vlastitu inicijativu, a 138 predmeta se odnosi na op\u0107e inicijative. Broj predmeta otvorenih temeljem pritu\u017ebi ili na vlastitu inicijativu uklju\u010duje one koje smo otvorili u 2024. godini, odnosno njih 420, te 193 predmeta iz ranijih godina u kojima smo postupali i u 2024. godini zbog slo\u017eenosti predmeta ili u kojima nismo pravovremeno zaprimili potrebne odgovore. U 2024. godini otvoreno je 106 predmeta op\u0107ih inicijativa, a u jo\u0161 32 je nastavljen rad iz prethodnih godina.<\/p>\n<p>Kao i ranijih godina, najve\u0107i je broj pritu\u017ebi na diskriminaciju zbog rase, etni\u010dke pripadnosti i boje ko\u017ee ili nacionalnog podrijetla, koje \u010dine 18% svih zaprimljenih diskriminacijskih pritu\u017ebi. Potom su sa 9% zastupljene pritu\u017ebe na diskriminaciju temeljem invaliditeta, koje smo ustupali pravobranitelju za osobe s invaliditetom, 9% na diskriminaciju temeljem zdravstvenog stanja, 7% na diskriminaciju temeljem obrazovanja te 6% na diskriminaciju zbog spola, koje smo ustupali pravobraniteljici za ravnopravnost spolova. Sve ostale osnove zastupljene su s manje od 5%, dok se u 17% pritu\u017ebi navodilo vi\u0161e od jedne diskriminacijske osnove. Slijedi podru\u010dje pristupa dobrima i uslugama te uprave, svako s 8%.<\/p>\n<p>73% svih diskriminacijskih pritu\u017ebi podnijele su nam fizi\u010dke osobe, pri \u010demu nam se obratilo ne\u0161to vi\u0161e \u017eena (169) nego mu\u0161karaca (137). Pri tome je potrebno istaknuti da broj zaprimljenih pritu\u017ebi ne odr\u017eava stvarnu prisutnost diskriminacije jer velik broj slu\u010dajeva i dalje ostaje neprijavljen. Zbog toga je i dalje potrebno raditi na podizanju svijesti gra\u0111ana o pojavama diskriminacije, zakonskoj zabrani te mehanizmima za za\u0161titu od diskriminacije. Osim toga, potrebno je raditi na podizanju razine svijesti i informiranosti o diskriminaciji kao zabranjenom postupanju svih pru\u017eatelja usluga te kontinuirano educirati stru\u010dnjake koji provode antidiskriminacijske propise.<\/p>\n<p>U Izvje\u0161\u0107u za 2023. godinu smo u okviru ovog poglavlja dali \u010detiri preporuke ULJPPNM, koje nas je u Izvje\u0161\u0107u o provedbi preporuka obavijestilo da su preporuke ispunjene ili \u0107e ih tek ispuniti u nadolaze\u0107em razdoblju.<\/p>\n<p>U odnosu na preporuku o nastavku edukacija stru\u010dne javnosti o pojavama diskriminacije u skladu sa specifi\u010dnim interesima i potrebama pojedinih ciljanih skupina, obavije\u0161teni smo da je realizacija u\u010dinjena u pogledu socijalnih radnika, \u0161to cijenimo djelomi\u010dnim ispunjavanjem preporuke i pohvaljujemo, no pri tome ukazujemo kako je va\u017eno nastaviti edukaciju razli\u010ditih segmenata stru\u010dne javnosti. Iz tog razloga, u ovom izvje\u0161\u0107u dali smo preporuku MZ da organizira edukaciju o ZSD-u za zdravstvene radnike i Akademiji socijalne skrbi da osigura edukaciju za zaposlenike u sustavu socijalne skrbi.<\/p>\n<p>U odnosu na preostale preporuke, provo\u0111enje istra\u017eivanja o prisutnosti diskriminacije u podru\u010dju pristupa dobrima i uslugama planirano je za naredni period provedbe Nacionalnog plana za\u0161tite i promicanja ljudskih prava i suzbijanje diskriminacije za razdoblje do 2027. godine. Pri tome, ukazujemo kako se planirane aktivnosti odnose na javni sustav, ali ne i privatni. Pritu\u017ebe koje zaprimamo pokazuju kako postoji niska svijest da se ZSD primjenjuje i na fizi\u010dke i pravne osobe u privatnom sektoru, pa smo tako zaprimali pritu\u017ebe vezano uz ulazak u kafi\u0107e ili oglase stanova za najam. Stoga, ponavljamo preporuku. Preporuke o kontinuiranom informiranju javnosti o zabrani diskriminacije i mehanizmima za\u0161tite te financiranja aktivnosti usmjerene promicanju jednakosti i suzbijanju diskriminacije na lokalnoj razini planiraju se provesti tijekom 2025. godine kroz otvoreni Poziv \u201ePrevencija diskriminacije i pru\u017eanje potpore \u017ertvama\u201c, kojim \u0107e se financijski podr\u017eati provedba relevantnih aktivnosti na regionalnoj i lokalnoj razini, a objava poziva planirana je u II kvartalu 2025. godine.\u00a0 S obzirom na va\u017enost preporuke te da je ista tek u planu provedbe,
