Gjithmon\u00eb e m\u00eb shum\u00eb, pun\u00ebtor\u00ebt e huaj, kryesisht shtetas nga vendet e treta, po na drejtohen me ankesa p\u00ebr shkelje t\u00eb t\u00eb drejtave t\u00eb tyre n\u00eb pun\u00eb.<\/p>\n<p>Ata shpesh denoncojn\u00eb se kan\u00eb punuar pa leje pune, pa kontrat\u00eb pun\u00ebsimi, se pun\u00ebdh\u00ebn\u00ebsi i tyre nuk u ka paguar pag\u00ebn p\u00ebr t\u00eb cil\u00ebn kan\u00eb r\u00ebn\u00eb dakord, ndonj\u00ebher\u00eb as pag\u00ebn minimale apo or\u00ebt e pun\u00ebs shtes\u00eb. Ata gjithashtu p\u00ebrmendin se u jan\u00eb mohuar pushimet e shkurtra gjat\u00eb dit\u00ebs s\u00eb pun\u00ebs, pushimet ditore ose javore si dhe e drejta p\u00ebr pushimet vjetore. Disa ankohen se, pas p\u00ebrfundimit t\u00eb marr\u00ebdh\u00ebnies s\u00eb pun\u00ebs, pun\u00ebdh\u00ebn\u00ebsi i tyre nuk u ka paguar kompensim p\u00ebr pushimet vjetore t\u00eb pakonsumuara. Ata gjithashtu jan\u00eb ankuar se pun\u00ebdh\u00ebn\u00ebsi i tyre nuk u ka dh\u00ebn\u00eb pasqyr\u00ebn e pag\u00ebs dhe disa kan\u00eb nxjerr\u00eb n\u00eb pah incidente me l\u00ebndime n\u00eb vendin e pun\u00ebs, t\u00eb cilat pun\u00ebdh\u00ebn\u00ebsi i tyre nuk i ka raportuar te Instituti Kroat p\u00ebr Sigurimin Sh\u00ebndet\u00ebsor. Disa na kan\u00eb kontaktuar edhe p\u00ebr ngacmim n\u00eb vendin e pun\u00ebs.<\/p>\n<p>K\u00ebto ankesa nxjerrin n\u00eb drit\u00eb edhe faktin se shpesh pun\u00ebtor\u00ebt nuk kan\u00eb informacion ku t\u00eb drejtohen p\u00ebr t\u00eb mbrojtur t\u00eb drejtat e tyre. Prandaj, n\u00eb tekstin m\u00eb posht\u00eb ne japim nj\u00eb panoram\u00eb t\u00eb p\u00ebrgjithshme t\u00eb problematikave m\u00eb t\u00eb zakonshme dhe informacion ligjor t\u00eb p\u00ebrgjithsh\u00ebm q\u00eb ne ua japim shpesh pun\u00ebtor\u00ebve t\u00eb huaj, duke p\u00ebrfshir\u00eb t\u00eb dh\u00ebnat e kontaktit t\u00eb institucioneve p\u00ebrkat\u00ebse. Ky informacion vlen p\u00ebr t\u00eb gjith\u00eb individ\u00ebt e pun\u00ebsuar n\u00eb Kroaci, pavar\u00ebsisht shtet\u00ebsis\u00eb s\u00eb tyre, por n\u00eb k\u00ebt\u00eb tekst ne theksojm\u00eb pun\u00ebtor\u00ebt e huaj, shtetasit e vendeve t\u00eb tjera, p\u00ebr disa arsye: rritja e numrit t\u00eb pun\u00ebtor\u00ebve t\u00eb huaj n\u00eb Kroaci, numri n\u00eb rritje i ankesave q\u00eb kan\u00eb dor\u00ebzuar te ne pun\u00ebtor\u00ebt e huaj, mungesa e informacionit nga ana e tyre p\u00ebr t\u00eb drejtat n\u00eb pun\u00eb dhe pamjaftueshm\u00ebria e informacionit t\u00eb disponuesh\u00ebm publik q\u00eb t\u00eb jet\u00eb specifik p\u00ebr ta.<\/p>\n<p>&nbsp;<\/p>\n<h3>Problemi:<\/h3>\n<ul>\n<li><strong>puna e padeklaruar (puna pa leje pune, pa kontrat\u00eb pune, pa u deklaruar n\u00eb autoritetet e sigurimeve shoq\u00ebrore dhe sh\u00ebndet\u00ebsore)<\/strong><\/li>\n<li><strong>puna pa pushim gjat\u00eb dit\u00ebs ose pa pushime ditore ose javore<\/strong><\/li>\n<li><strong>or\u00ebt e pun\u00ebs shtes\u00eb t\u00eb paligjshme ose t\u00eb papaguara<\/strong><\/li>\n<li><strong>mospagesa e pag\u00ebs<\/strong><\/li>\n<li><strong>mospagesa e kompensimit p\u00ebr pushimet vjetore t\u00eb pakonsumuara pas p\u00ebrfundimit t\u00eb pun\u00ebsimit<\/strong><\/li>\n<li><strong>mosdh\u00ebnia e pasqyr\u00ebs s\u00eb pag\u00ebs q\u00eb pun\u00ebdh\u00ebn\u00ebsi ka detyrimin t\u00eb paguaj\u00eb dhe p\u00ebr pag\u00ebn e papaguar dhe\/ose p\u00ebr kompensimin e pushimeve vjetore t\u00eb pakonsumuara<\/strong><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>\u00c7far\u00eb mund t\u00eb b\u00ebni? <\/strong>K\u00ebto probleme duhet t\u00eb denoncohen te Inspektorati Shtet\u00ebror i Pun\u00ebs i Republik\u00ebs s\u00eb Kroacis\u00eb.<\/p>\n<p><strong>Si ta b\u00ebni denoncimin? <\/strong><a href=\"https:\/\/dirh.gov.hr\/podnosenje-prijava\/83\">Duke p\u00ebrdorur formularin<\/a> n\u00eb faqen e internetit t\u00eb Inspektoratit Shtet\u00ebror t\u00eb Pun\u00ebs. Formularin e gjeni <a href=\"https:\/\/dirh.gov.hr\/podnosenje-prijava\/83\">k\u00ebtu<\/a>.<\/p>\n<p>P\u00ebr m\u00eb shum\u00eb informacion si t\u00eb depozitoni nj\u00eb denoncim, mund t\u00eb kontaktoni inspektorin e pun\u00ebs n\u00eb detyr\u00eb n\u00eb Zagreb, Split, Rijek\u00eb, Osijek\u00eb ose Vara\u017edin. Pun\u00ebdh\u00ebn\u00ebsi ka detyrimin t\u2019jua jap\u00eb k\u00ebt\u00eb llogaritje.<\/p>\n<p>M\u00eb pas, mund ta d\u00ebrgoni k\u00ebt\u00eb llogaritje te FINA p\u00ebr ta zgjidhur \u00e7\u00ebshtjen pa kaluar nga procedurat gjyq\u00ebsore. Kjo gj\u00eb \u00ebsht\u00eb e mundur sepse sipas nenit 93 paragrafi 5 i Kodit t\u00eb Pun\u00ebs, llogaritja e pagave q\u00eb ju detyrohen ose e pagave t\u00eb papaguara \u00ebsht\u00eb dokument i ekzekutuesh\u00ebm.<\/p>\n<p>P\u00ebrve\u00e7 k\u00ebsaj, mund ta denonconi pun\u00ebdh\u00ebn\u00ebsin tuaj te Inspektorati i Pun\u00ebs (n\u00eb m\u00ebnyr\u00ebn e p\u00ebrshkruar m\u00eb lart).<\/p>\n<p><strong>\u00c7far\u00eb ndodh n\u00ebse pun\u00ebdh\u00ebn\u00ebsi nuk jua jep llogaritjen e pag\u00ebs ose nuk paguan edhe pas inspektimit? <\/strong>N\u00eb k\u00ebt\u00eb rast, mund t\u00eb nisni procedurat gjyq\u00ebsore, p\u00ebr t\u00eb cilat do t\u00eb keni nevoj\u00eb p\u00ebr ndihm\u00ebn ligjore t\u00eb nj\u00eb avokati ose nj\u00eb sindikate (n\u00ebse jeni an\u00ebtar sindikate). Informacionin se kush ka t\u00eb drejt\u00ebn t\u00eb marr\u00eb ndihm\u00eb ligjore falas dhe si mund ta merrni at\u00eb, e gjeni <a href=\"https:\/\/www.ombudsman.hr\/hr\/kako-dobiti-besplatnu-pravnu-pomoc\/\">k\u00ebtu<\/a>.<\/p>\n<p><strong>\u00c7far\u00eb afati keni p\u00ebr t\u00eb k\u00ebrkuar pagat e papaguara?<\/strong> Mund t\u2019i k\u00ebrkoni k\u00ebto paga brenda nj\u00eb afati prej pes\u00eb vitesh, afat q\u00eb fillon nga dita ku pun\u00ebdh\u00ebn\u00ebsi ka pasur detyrimin p\u00ebr t\u00eb paguar pag\u00ebn.<\/p>\n<p>M\u00eb shum\u00eb informacion p\u00ebr mospages\u00ebn e pagave <a href=\"https:\/\/www.ombudsman.hr\/hr\/sto-uciniti-kad-poslodavac-ne-isplacuje-placu\/\">mund t\u00eb gjeni n\u00eb tekstin k\u00ebtu<\/a>.<\/p>\n<p>&nbsp;<\/p>\n<h3>Problemi: pagesa e pagave ose e nj\u00eb pjese t\u00eb pag\u00ebs \u201cn\u00ebn dor\u00eb\u201d n\u00eb vend q\u00eb t\u00eb paguhen n\u00eb llogarin\u00eb bankare t\u00eb pun\u00ebtorit.<\/h3>\n<p><strong>\u00c7far\u00eb mund t\u00eb b\u00ebni? <\/strong>Kjo m\u00ebnyr\u00eb pagese \u00ebsht\u00eb e paligjshme dhe mund ta denonconi pun\u00ebdh\u00ebn\u00ebsin tuaj n\u00eb Administrat\u00ebn Tatimore t\u00eb Ministris\u00eb s\u00eb Financave.<\/p>\n<p><strong>Si ta b\u00ebni denoncimin? <\/strong>Denoncimin mund ta b\u00ebni n\u00ebp\u00ebrmjet nj\u00ebr\u00ebs prej k\u00ebtyre m\u00ebnyrave:<\/p>\n<ul>\n<li>me post\u00eb n\u00eb <a href=\"https:\/\/www.porezna-uprava.hr\/Adresar\/Stranice\/default.aspx\">nj\u00ebr\u00ebn prej adresave n\u00eb k\u00ebt\u00eb faqe<\/a>, n\u00eb var\u00ebsi t\u00eb qytetit ku jeni ose n\u00eb adres\u00ebn m\u00eb t\u00eb af\u00ebrt<\/li>\n<li>duke p\u00ebrdorur formularin q\u00eb e gjeni <a href=\"https:\/\/pisitenam.porezna-uprava.hr\/\">k\u00ebtu<\/a><\/li>\n<li>duke telefonuar n\u00eb numrin pa pages\u00eb 0800 1001 (nga e h\u00ebna deri t\u00eb premten, nga ora 8:00 deri n\u00eb or\u00ebn 15:00).<\/li>\n<\/ul>\n<p><strong>A do t\u2019ju njoftoj\u00eb Administrata Tatimore n\u00ebse ka vepruar dhe si ka vepruar me denoncimin tuaj?<\/strong> Jo, inspektor\u00ebt tatimor\u00eb nuk kan\u00eb detyrimin t\u2019ju informojn\u00eb sepse me ligj ata kan\u00eb detyrimin t\u00eb mbajn\u00eb fsheht\u00ebsin\u00eb p\u00ebr kontrollet tatimore (sipas Ligjit t\u00eb P\u00ebrgjithsh\u00ebm p\u00ebr Tatimet, \u00a0neni 8).<\/p>\n<p>&nbsp;<\/p>\n<h3>Problemi: l\u00ebndimet n\u00eb vendin e pun\u00ebs q\u00eb pun\u00ebdh\u00ebn\u00ebsi nuk i ka deklaruar n\u00eb Institutin Kroat p\u00ebr Sigurimet Sh\u00ebndet\u00ebsore (HZZO).<\/h3>\n<p><strong>\u00c7far\u00eb mund t\u00eb b\u00ebni? <\/strong>N\u00eb rastet ku pun\u00ebmarr\u00ebsi ka p\u00ebsuar l\u00ebndime n\u00eb vendin e pun\u00ebs, pun\u00ebdh\u00ebn\u00ebsi ka detyrimin ligjor ta deklaroj\u00eb k\u00ebt\u00eb l\u00ebndim n\u00eb vendin e pun\u00ebs te autoriteti kompetent, i cili \u00ebsht\u00eb Instituti Kroat p\u00ebr Sigurimet Sh\u00ebndet\u00ebsore (HZZO),\u00a0 brenda 8 dit\u00ebve nga data kur ka ndodhur l\u00ebndimi.<\/p>\n<p>Pun\u00ebmarr\u00ebsi, qoft\u00eb ky edhe i huaj, mund ta deklaroj\u00eb vet\u00eb, por jo m\u00eb von\u00eb se brenda tre viteve nga skadimi i afatit n\u00eb t\u00eb cilin k\u00ebt\u00eb deklarim duhej ta b\u00ebnte pun\u00ebdh\u00ebn\u00ebsi.\u00a0 N\u00ebse mendoni se \u00ebsht\u00eb e nevojshme, para se ta deklaroni vet\u00eb l\u00ebndimin n\u00eb vendin e pun\u00ebs, mund t\u00eb merrni m\u00eb shum\u00eb informacion pran\u00eb zyr\u00ebs <a href=\"https:\/\/hzzo.hr\/o-nama\/regionalni-uredi-i-podrucne-sluzbe\">m\u00eb t\u00eb af\u00ebrt<\/a> t\u00eb HZZO-s\u00eb ose <a href=\"https:\/\/hzzo.hr\/ozljede-na-radu-i-profesionalne-bolesti-specificna-zdravstvena-zastita\/1-ozljeda-na-radu\">k\u00ebtu<\/a>.<\/p>\n<p>&nbsp;<\/p>\n<h3>Problemi: ngacmimi n\u00eb vendin e pun\u00ebs (mobbing)<\/h3>\n<p><strong>Si ta dalloni ngacmimin (mobbing)? <\/strong>Pavar\u00ebsisht se nuk ka nj\u00eb p\u00ebrkufizim ligjor p\u00ebr ngacmimin n\u00eb vendin e pun\u00ebs (mobbing), me k\u00ebt\u00eb term zakonisht kuptojm\u00eb \u00e7do lloj forme t\u00eb dhun\u00ebs n\u00eb vendin e pun\u00ebs t\u00eb karakterizuar nga abuzimi psikologjik ose moral.<\/p>\n<p>K\u00ebtu mund t\u00eb hyjn\u00eb format e ndryshme t\u00eb shmangies, izolimit dhe pengimit t\u00eb t\u00eb pasurit t\u00eb kontakteve n\u00eb pun\u00eb, sulmet ndaj reputacionit t\u00eb personit ose komentet negative p\u00ebr karakteristikat personale t\u00eb viktim\u00ebs.<\/p>\n<p>Si shembuj mund t\u00eb p\u00ebrmendim kritikat dhe ankesat e vazhdueshme p\u00ebr pun\u00ebn e dikujt, fyerjet ose shp\u00ebrfilljen, kontrollin e tep\u00ebrt, zhvendosjen e p\u00ebrgjegj\u00ebsive, nd\u00ebshkimin, vler\u00ebsimin e ul\u00ebt p\u00ebr pun\u00ebn, paaft\u00ebsin\u00eb p\u00ebr t\u2019u ngritur n\u00eb karrier\u00eb, mohimin ose caktimin e detyrave t\u00eb pap\u00ebrshtatshme dhe\/ose t\u00eb ndaluara, transferimet e pajustifikuara dhe veprime t\u00eb ngjashme q\u00eb d\u00ebmtojn\u00eb sh\u00ebndetin e pun\u00ebmarr\u00ebsit ose shkelin t\u00eb drejtat e tij.<\/p>\n<p><strong>Ku duhet t\u00eb ankoheni?<\/strong> Hapi i par\u00eb \u00ebsht\u00eb t\u2019i drejtoheni pun\u00ebmarr\u00ebsit, me sakt\u00eb personit t\u00eb autorizuar p\u00ebr t\u00eb marr\u00eb dhe zgjidhur ankesat e lidhura me dinjitetin e pun\u00ebmarr\u00ebsve.
