On 11 June 2026, Ombudswoman Tena \u0160imonovi\u0107 Einwalter participated in the round table entitled \u201cCase Law on the Criminal Offence under Article 314, paragraphs 1 and 2 of the Criminal Code \u2013 Criminal Law, Social and Security Aspects of the Criminal Offence of Coercion against an Official Person\u201d<\/em>, organised by the Judiciary Committee of the Croatian Parliament.<\/p>\n

Speaking on this topic, the Ombudswoman emphasised that the issue of attacks on persons performing duties of public interest and security, such as police officers, who are the most exposed, but also all others acting in a public function, including workers in healthcare, the judiciary, social welfare, the media and similar sectors, requires a serious discussion based on facts and without sensationalism, in order to prevent future incidents.<\/p>\n

Referring to cases in which the perpetrators are foreign nationals, she warned that there is no need to create panic among citizens, as such an approach may provoke unwanted social reactions and additional incidents. At the same time, every individual who commits a criminal offence should be adequately sanctioned, regardless of whether they are a foreign or Croatian national.<\/p>\n

The Ombudswoman then presented specific recommendations.<\/p>\n

It is necessary to prepare a detailed expert analysis of the legal framework concerning the criminal offences of coercion against a judicial official, as referred to in Article 312 of the Criminal Code; coercion against an official person, as referred to in Article 314 of the Criminal Code; assault against an official person, as referred to in Article 315 of the Criminal Code; coercion against a healthcare worker, as referred to in Article 315.a of the Criminal Code; and coercion against a person performing duties in the public interest or in the public service, as referred to in Article 315.b of the Criminal Code.<\/p>\n

It is also necessary to prepare a detailed expert analysis of case law related to these articles of the Criminal Code.<\/p>\n

On the basis of these analyses, it is then necessary to determine whether the Criminal Code should be amended and\/or whether training should be provided for judicial officials, and in relation to which specific aspects.<\/p>\n

Finally, communication with the public concerning court decisions should be improved through court spokespersons.<\/p>\n

The Ombudswoman submitted these recommendations to the Judiciary Committee at its request, for the purposes of preparing the conclusions of the thematic session.<\/p>\n
