At the same time, every individual who commits a criminal offence should be adequately sanctioned, regardless of whether they are a foreign or Croatian national.

The Ombudswoman then presented specific recommendations.

It is necessary to prepare a detailed expert analysis of the legal framework concerning the criminal offences of coercion against a judicial official, as referred to in Article 312 of the Criminal Code; coercion against an official person, as referred to in Article 314 of the Criminal Code; assault against an official person, as referred to in Article 315 of the Criminal Code; coercion against a healthcare worker, as referred to in Article 315.a of the Criminal Code; and coercion against a person performing duties in the public interest or in the public service, as referred to in Article 315.b of the Criminal Code.

It is also necessary to prepare a detailed expert analysis of case law related to these articles of the Criminal Code.

On the basis of these analyses, it is then necessary to determine whether the Criminal Code should be amended and/or whether training should be provided for judicial officials, and in relation to which specific aspects.

Finally, communication with the public concerning court decisions should be improved through court spokespersons.

The Ombudswoman submitted these recommendations to the Judiciary Committee at its request, for the purposes of preparing the conclusions of the thematic session.

In addition to Ombudswoman Šimonović Einwalter, the discussion was attended by the Chair of the Judiciary Committee Nikola Grmoja, Deputy Chair of the Committee Nikola Mažar and other Committee members; Deputy Prime Minister and Minister of the Interior Davor Božinović; State Secretary at the Ministry of Justice, Public Administration and Digital Transformation Ivan Crnčec; Chief Police Director Nikola Milina; Deputy Attorney General Andrea Šurina Marton; Dražen Tripalo from the Supreme Court of the Republic of Croatia; Ivona Horvatić from the Municipal Criminal Court in Zagreb; Marin Mrčela from the Association of Croatian Judges; President of the Police Trade Union of Croatia Dubravko Jagić; and other members of the Committee.

On 11 June 2026, Ombudswoman Tena Šimonović Einwalter participated in the round table entitled “Case Law on the Criminal Offence under Article 314, paragraphs 1 and 2 of the Criminal Code – Criminal Law, Social and Security Aspects of the Criminal Offence of Coercion against an Official Person”, organised by the Judiciary Committee of the […]

[169

post-24302","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-news
["GET
