{"id":21550,"date":"2025-02-25T11:21:05","date_gmt":"2025-02-25T09:21:05","guid":{"rendered":"https:\/\/www.ombudsman.hr\/en\/?p=21508"},"modified":"2025-11-25T16:50:20","modified_gmt":"2025-11-25T14:50:20","slug":"roundtable-on-dignified-ageing-and-palliative-care","status":"publish","type":"post","link":"https:\/\/www.ombudsman.hr\/en\/roundtable-on-dignified-ageing-and-palliative-care\/","title":{"rendered":"Roundtable on Dignified Ageing and Palliative Care"},"content":{"rendered":"<p><span lang=\"EN-US\">As part of the project <em>&#8220;Circles of Support for Older Persons&#8221;<\/em>, implemented by the organisation <em>Krugovi \u2013 Centre for Education, Counselling and Humanitarian Work<\/em>, a roundtable titled <em>&#8220;Urgent Action for Dignified Ageing and Palliative Care&#8221;<\/em> was held on 25 February 2025, with participation from Deputy Ombudswoman Tatjana Vla\u0161i\u0107.<\/span><\/p>\n<p><span lang=\"EN-US\">In the first panel, which focused on <strong>lifetime and lifelong support agreements<\/strong>, Deputy Ombudswoman Vla\u0161i\u0107 emphasised that abuses of these contracts are closely linked to the poverty experienced by many older persons, as well as to the limited availability of in-home support services and insufficient capacities in long-term care institutions\u2014issues the Ombudswoman, Tena \u0160imonovi\u0107 Einwalter, has been warning about for years.<\/span><\/p>\n<p><span lang=\"EN-US\">Deputy Vla\u0161i\u0107 also pointed to <strong>positive developments<\/strong>, some of which were prompted by the Ombudswoman\u2019s recommendations. These include the introduction of protective mechanisms aimed at preventing the abuse of such contracts, particularly <strong>lifelong support agreements<\/strong>, in which ownership of assets is transferred immediately upon signing\u2014something many older persons are unaware of, often resulting in loss of property and lack of the promised care.<\/span><\/p>\n<p><span lang=\"EN-US\">For example, over the past year, the number of contracts a single provider can enter into was limited, the naming of contracts was amended to clearly indicate when asset transfer occurs, and a <strong>Register of Support Contracts<\/strong> was established.<\/span><\/p>\n<p><span lang=\"EN-US\">Moreover, the total number of these contracts declined over the past year\u2014by 15% in the case of lifetime support contracts (where the asset transfer occurs after death) and by 20% for lifelong support contracts (with immediate asset transfer)\u2014reversing the previous upward trend in the number of such agreements.<\/span><\/p>\n<p><span lang=\"EN-US\">Deputy Vla\u0161i\u0107 noted that these are indeed steps in the right direction, but that <strong>further improvements<\/strong> are necessary to enhance the protection of older persons&#8217; rights in this context. These could include, for instance, <strong>improving public awareness<\/strong>, particularly among older persons, about the legal and practical implications of these agreements, and prohibiting such contracts from being concluded with <strong>legal entities providing social care services<\/strong>, as well as <strong>individuals employed in the social care sector<\/strong>.<\/span><\/p>\n<p><span lang=\"EN-US\">She also stressed the importance of effective implementation of recent amendments to the Civil Procedure Act, which designate proceedings on the termination of these contracts as urgent. In practice, however, such court proceedings still last for several years\u2014an issue of great concern for older persons relying on the fulfilment of these agreements.<\/span><\/p>\n<p><span lang=\"EN-US\">In the second panel, which focused on <strong>palliative care<\/strong>, Deputy Vla\u0161i\u0107 highlighted that, according to hospital data, there is an increasing trend in cancer and other chronic illnesses, which has led to growing demand for palliative care. Unfortunately, however, the development of palliative care in Croatia remains <strong>very slow<\/strong>.<\/span><\/p>\n<p><span lang=\"EN-US\">According to the Croatian Health Insurance Fund (HZZO), the number of <strong>primary care palliative teams<\/strong> has not increased since last year. A significant issue is the <strong>shortage of doctors<\/strong> in mobile palliative teams, as well as professionals from other fields such as <strong>social workers, psychologists, spiritual counsellors, and physiatrists<\/strong>\u2014which means no mobile palliative care team currently meets European standards for completeness.<\/span><\/p>\n<p><span lang=\"EN-US\">Since the <strong>National Programme for the Development of Palliative Care in the Republic of Croatia for the period 2023\u20132026<\/strong> has not yet been adopted, Deputy Vla\u0161i\u0107 underlined the need for its <strong>urgent adoption<\/strong>, which is also among the Ombudswoman\u2019s formal recommendations.<\/span><\/p>\n<p><span lang=\"EN-US\">She also drew attention to other systemic issues, such as <strong>inadequate communication with patients and their families<\/strong>, lack of <strong>joint care planning<\/strong>, insufficient <strong>monitoring and support<\/strong>, obstacles in exercising the right to <strong>home healthcare<\/strong>, <strong>poor interdisciplinary collaboration<\/strong> within facilities, and insufficient <strong>coordination between health and social care systems<\/strong>, along with a general <strong>lack of training among professionals<\/strong>, and a shortage of <strong>in-patient care<\/strong> for individuals requiring specialised support.<\/span><\/p>\n<p><span lang=\"EN-US\">In addition to Deputy Vla\u0161i\u0107, the first panel featured \u0160tefica Salaj from the Croatian Pensioners\u2019 Union, Olga Jel\u010di\u0107 from the Croatian Law Centre, and Vi\u0161nja Fortuna from the Pensioners\u2019 Association of Croatia. The panel was moderated by Petra Klasi\u0107 from the organisation <em>Krugovi<\/em>. The second panel included Bla\u017eenka Eror Mati\u0107 from the association <em>La Verna<\/em>, Nada Tomasovi\u0107 Mr\u010dela from the Andrija \u0160tampar Teaching Institute of Public Health, as well as Ivana \u0110erek Dubrav\u010di\u0107 and Antonija Bobi\u0107 Lazi\u0107 from the City of Zagreb. The discussion was moderated by Gordana \u0160imunkovi\u0107 from the University of Rijeka, Faculty of Medicine.<\/span><\/p>\n<p><span lang=\"EN-US\">The roundtable was organised as part of the <strong>Impact4Values<\/strong> programme. Along with <em>Krugovi \u2013 Centre for Education, Counselling and Humanitarian Work<\/em>, the Croatian Law Centre, the Croatian Youth Network, and the Croatian Pensioners\u2019 Union also participated in the project.
